Lok Adalats are functioning in the High Court w.e.f. 23rd September, 2008

Two Continuous Lok Adalats are functioning in the High Court w.e.f. 23rd September, 2008 onwards. The Continuous Lok Adalats are being organized on every Tuesday and Wednesday which are presided over by former Judges of the High Court along with a practicing Advocate of the High Court who are being drawn mainly from the legal aid panel of the Committee. On Saturdays, the Continuous Lok Adalat is presided over by sitting Judges of the High Court along with a practicing Advocates.

This is for the information to all the Advocates and litigants and if they are desirous of an amicable and expeditious disposal of their cases, they can approach the Committee for reference of their cases to Lok Adalats.

It may noted that the continuous Lok adalat functioning from 23rd September, 2008 in the high court is not a ‘Permanent Lok Adalat’ as envisaged under chapter-vi a, legal services authorities act, 1987 and that the settlement process before the said continuous Lok Adalat shall be voluntary and where no award is made by Lok Adalat on the ground that no compromise or settlement could be arrived at, the matters shall be referred back to the court concerned for disposal in accordance with law.

The following types of cases are being taken up in the Lok Adalat :-
i) APPEALS ARISING OUT OF MOTOR ACCIDENT CLAIM PETITIONS.

ii) CLR. REVISIONS/CRL. M.CS ARISING OUT OF COMPLAINTS UNDER SECTION 138 NEGOTIABLE INSTRUMENTS ACT.

iii) CRL. APPEALS/CRL. REVISIONS/CRL.M.CS ARISING OUT OF COMPLAINTS UNDER SECTION 498A, INDIAN PENAL CODE.

iv) APPEALS ARISING OUT OF BANK RECOVERY SUITS AND PARTITION SUITS.

v) MATRIMONIAL APPEALS/CIVIL MISC. MAINS IN MATRIMONIAL MATTERS. vi) OLD CIVIL WRIT PETITIONS IN LABOUR MATTERS.
